Finished Materials – Care, Maintenance & Post-Completion Responsibility
Upon completion of the project and final delivery to the Client, all installed finish materials—including, but not limited to, flooring, tile, stone, countertops, cabinetry, millwork, fixtures, hardware, glass, paint, finishes, and other decorative or finished surfaces—become the Client’s responsibility for proper use, care, cleaning, protection, and maintenance.
The Contractor is not responsible for damage, deterioration, staining, scratching, chipping, discoloration, fading, etching, cracking, warping, water or moisture damage, chemical damage, excessive wear, impact damage, or other changes occurring after project completion that result from normal wear and tear, misuse, lack of maintenance, improper cleaning methods or products, environmental conditions, actions of occupants, guests, pets, movers or other third parties, or failure to follow manufacturer care and maintenance instructions.
Natural materials may contain inherent variations in color, texture, grain, veining, pattern, porosity, and appearance. Such naturally occurring characteristics and reasonable variations between samples, displays, photographs, and installed materials shall not be considered defects in workmanship.
The Client is responsible for following all manufacturer-recommended care, maintenance, cleaning, sealing, and protection requirements applicable to installed materials and products. Manufacturer warranties, where applicable, remain subject to the manufacturer’s own terms, conditions, limitations, and claim procedures.
This provision does not exclude or limit responsibility for defective workmanship or installation attributable to the Contractor, or any warranty, obligation, or liability that cannot legally be waived or limited under applicable California law.
To the fullest extent permitted by California law, once the project has been completed and accepted by the Client, maintenance, ordinary wear and tear, and damage arising from the Client’s use, care, maintenance, or subsequent alteration of finished materials are the responsibility of the Client.
